These Terms and Conditions (“Agreement”) are a legal agreement between you, the user, and Pramaan.ai (“we,” “us,” or “our”), a company providing background verification services. By accessing or using our platform, products, or services (collectively, the “Services”), you agree to comply with and be bound by these Terms and Conditions. If you do not agree to these Terms and Conditions, you should not use our Services.

1. Acceptance of Terms

By accessing or using the Pramaan.ai platform and its associated services, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions. If you are accessing our Services on behalf of an organization, you represent and warrant that you are authorized to agree to these terms on behalf of the organization.

2. Definitions

  • Customer: Any individual or entity that subscribes to Pramaan.ai’s background verification services.
  • Candidate: Any individual whose background is being verified via Pramaan.ai’s services.
  • Platform: Refers to the Pramaan.ai website, mobile application, or any other digital interface provided by us through which our Services are accessed.
  • Services: The background verification services provided by Pramaan.ai, including but not limited to identity verification, employment verification, educational verification, criminal background checks, and related services.

3. Services Provided

Pramaan.ai provides background verification services to Customers who request these services on their employees or candidates (the "Candidate"). The services include but are not limited to:

  • Identity Verification: Verifying personal identity information provided by Candidates.
  • Educational Verification: Verifying academic credentials and qualifications of Candidates.
  • Employment Verification: Verifying the employment history of Candidates.
  • Criminal Background Checks: Verifying whether Candidates have any criminal records or pending legal matters.
  • Credit Score and Financial Background Checks: Collecting and analyzing credit information for Candidates as requested by the Customer.
  • Other Checks: Performing any other background checks as requested by the Customer, subject to legal compliance and consent from the Candidate.

4. User Responsibilities

a) Customer Responsibilities:
  • Provide accurate and complete information when requesting background verification services.
  • Ensure that all Candidates whose data is being verified have given explicit consent for the collection and processing of their personal information.
  • Comply with all applicable laws and regulations regarding data protection, privacy, and employment screening.
  • Use the results of background checks solely for the purposes intended (e.g., employment decisions) and not for any unlawful or discriminatory purpose.
b) Candidate Responsibilities:
  • Provide accurate and truthful information when requested for background verification.
  • Give explicit consent to Pramaan.ai to process and verify your personal information for the purposes specified in the Customer’s request.
  • Cooperate with any additional documentation or verification requests related to your background check.

5. Privacy and Data Protection

Your use of our Services is governed by our Privacy Policy, which explains how we collect, use, and protect your personal data. By using the Services, you agree to the collection and use of information in accordance with our Privacy Policy.

6. Fees and Payment

  • Fees: You agree to pay the fees associated with the Services as specified by Pramaan.ai. Fees may vary depending on the type of background verification requested. The applicable fees will be clearly communicated before you complete any transaction.
  • Payment: Payment for the Services is processed through secure payment gateways. You are responsible for all charges associated with the use of the Services, including applicable taxes.
  • Refunds: All payments are non-refundable, unless otherwise specified by Pramaan.ai. In case of an error or issue with the services provided, refunds may be issued at Pramaan.ai’s discretion.

7. Data Accuracy and Limitations

Pramaan.ai strives to provide accurate and reliable background verification reports based on the information available publicly. However, we do not guarantee the completeness or absolute accuracy of the information provided. Background checks depend on the availability of data from third-party sources and may be subject to errors or omissions beyond our control.

  • Accuracy of Information: Customers and Candidates are responsible for ensuring that the information provided for verification is accurate and up-to-date.
  • No Guarantee of Results: Pramaan.ai does not guarantee specific outcomes from background verification services. The results are based on available data, and the outcome of the verification process may vary.

8. Use of Reports

The background verification reports provided by Pramaan.ai are solely intended for the purposes outlined by the Customer (e.g., employment screening). You agree not to use these reports for any unlawful or unauthorized purposes, including but not limited to:

  • Discriminating against or harassing individuals based on the results of a background check.
  • Making decisions that violate anti-discrimination laws, privacy regulations, or employment laws.

9. Restrictions on Use

  • Use the Platform or Services for any illegal, unauthorized, or unethical purposes.
  • Interfere with the proper operation of the Platform or attempt to access or use any portion of the Platform without authorization.
  • Use any data obtained through our Services for purposes other than those expressly authorized by Pramaan.ai.

10. Intellectual Property

All intellectual property rights, including copyrights, trademarks, and proprietary rights, related to the Platform and Services are owned by Pramaan.ai or its licensors. You agree not to copy, reproduce, distribute, or create derivative works based on any part of the Platform or Services without express written permission from Pramaan.ai.

11. Termination

Pramaan.ai reserves the right to suspend or terminate your access to the Platform and Services, without notice, if we believe that you have violated these Terms and Conditions, the Privacy Policy, or any applicable laws.

12. Indemnification

You agree to indemnify, defend, and hold harmless Pramaan.ai, its officers, directors, employees, agents, and affiliates from any claims, losses, liabilities, damages, costs, or expenses arising out of or related to your violation of these Terms and Conditions, your use of the Services, or any third-party claims arising from the information you provide to Pramaan.ai.

13. Limitation of Liability

To the fullest extent permitted by law, Pramaan.ai shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with the use of the Platform or Services, including but not limited to any errors or inaccuracies in background verification reports.

14. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of Delhi jurisdiction. Any disputes arising under or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts in Delhi Jurisdiction.

15. Amendments

Pramaan.ai reserves the right to modify, update, or change these Terms and Conditions at any time. All changes will be posted on this page with an updated effective date. You are encouraged to review these Terms periodically to stay informed about any changes.
